The idea that government has a 'compelling' reason to discriminate it absurd. This thought pattern is being applied to other areas of law also, such as the GM bancruptcy and invasion of privacy, haveus corpus, miranda rights, freedom of assembly and gun rights. The country was founded on the concept of one law for all, not on the idea that the government had one set of rules and the people had another set. Discrimination based on skin color etc. is a bad thing, and actually worse is caused by law.
